Death warrant not yet issued against Nirbhaya convicts, hearing deferred

The Supreme Court has dismissed the reconsideration petition of Akshay Kumar, convicted of the Nirbhaya case. It is noteworthy that Akshay Kumar, a convict in the Nirbhaya case, had filed a review petition in the Supreme Court to reduce the death sentence, which has been turned down by the apex court. Counsel for the convict AP Singh said that a curative petition will be filed on behalf of his client in the Supreme Court. After the decision of the Supreme Court, Akshay’s lawyer AP Singh has said to file a curative petition. Nirbhaya’s mother’s plea was heard in Delhi’s Patiala House court after Akshay’s reconsideration petition was rejected by the Supreme Court. The court said that until the mercy petition of the convicts is dismissed from the President, the death warrant cannot be issued. With this, the court postponed the hearing till 7 January.

During the hearing, the public prosecutor said that if the convicts are given 14 days, then a death warrant can be issued in the case. Nirbhaya’s mother had filed a petition in the Patiala House Court demanding that the culprits be hanged soon. During the hearing on the petition of Nirbhaya’s mother, the Judge of the Patiala House Court said that the court has to follow the principle of Principal of Justice.

The government lawyer argued that seven days are given even after the death warrant is issued against the culprits. It may be noted that Akshay Kumar, a convict in the Nirbhaya case, had filed a review petition in the Supreme Court to reduce the death sentence, which has been turned down by the apex court. Counsel for the convict AP Singh said that a curative petition will be filed on behalf of his client in the Supreme Court.
Nirbhay’s father has made a passionate comment on the Supreme Court’s decision. He said that his journey so far has been painful and heavy every single moment. Nirbhaya’s father tears up after the Patiala House Court defers a verdict on Yachika. Before the decision of the Patiala House Court, Nirbhaya’s mother had said that she had patience for seven years, now the hour of judgment is near. This case has been in court for the last seven years. After the decision of the Supreme Court, now Akshay’s lawyer AP Singh has said to file a curative petition.
